Money-Back Promise

This is a money-back promise, not a guarantee of approval. USCIS decides every petition independently. We do not and cannot promise that any petition will be approved. What we promise is simple: if you qualify under the terms below and the petition you prepared with CaseBuilder is finally denied, you choose either a refund of what you paid CaseBuilder for that case, or a free rebuild of your petition.

1. What this promise is

The money-back promise is a limited remedy commitment for qualifying cases, giving you a choice of a refund or a free rebuild of your petition (see section 4). It is not legal advice, not an insurance policy, and not a guarantee that USCIS will approve your petition. It applies only to the CaseBuilder product fee for a single qualifying case, and only when every condition in these terms is met.

2. Who qualifies

The promise applies to a paid full petition package (EB-2 NIW, EB-1A, or O-1A) where all of the following are true:

  1. You completed the full intake for the case in CaseBuilder.
  2. You uploaded every document the platform flagged as required for your case before generating the final package.
  3. You ran the platform's final pre-filing review on the package you filed.
  4. You filed the petition with USCIS within 12 months of your purchase date.
  5. The information you provided was truthful and complete.

Each condition is recorded in your case history, visible to you in your workspace. Eligibility is determined by these recorded steps only. CaseBuilder does not make case-by-case judgments about eligibility after purchase.

One promise applies per qualifying paid case. It is personal to the beneficiary of that case and is not transferable.

3. What triggers the promise

The promise is triggered by a final denial by USCIS of the petition you filed using the package prepared in CaseBuilder for that case:

  • For EB-1A and EB-2 NIW, the immigrant petition on Form I-140.
  • For O-1A, the nonimmigrant petition on Form I-129.

"Final" means either (a) the 30-day period to appeal or file a motion has passed without a filing, or (b) an appeal or motion you filed has been decided and the denial stands.

A Request for Evidence (RFE), a Notice of Intent to Deny (NOID), a rejection for a filing or fee defect, or a withdrawal is not a denial and does not trigger this promise. An RFE is a request for more evidence, not a decision on the merits. CaseBuilder offers a separate RFE response product for that situation.

4. Your choice: refund or free rebuild

If you qualify and your case is finally denied, you choose ONE of the following. They are mutually exclusive: choosing one resolves the promise, and you cannot receive both.

Option A - Refund. We refund the price you paid CaseBuilder for that case (the software product fee). This does not include USCIS filing fees or any other government fees, premium-processing fees, translation or courier costs, attorney fees, or any other third-party expense. USCIS and government fees are never refundable by CaseBuilder because they are paid to the government, not to us.

Option B - Free rebuild. Instead of a refund, we prepare, at no additional CaseBuilder product fee, one new petition package for the same beneficiary, rebuilt to address the reasons stated in the denial and to incorporate any new evidence you provide. You still review and file it yourself, and you remain responsible for any USCIS or other government fees. This is one rebuilt package for the same beneficiary, not unlimited revisions.

5. How and when to claim

Submit your claim within 90 days of the date on your final USCIS denial notice. There is no time limit on how long USCIS takes to decide: as long as you filed within 12 months of purchase, the promise covers your case whenever the decision arrives. Write to contact@casebuilder.online. Include:

  • The official USCIS denial notice for the petition, showing a beneficiary name that matches the name on your CaseBuilder case.
  • The email address associated with your CaseBuilder account and the case involved.
  • Which remedy you want: a refund, or a free rebuild of your petition (section 4).

We may ask for reasonable additional documentation to confirm that the petition you filed was the one prepared with your CaseBuilder package. We review complete claims within a reasonable time. Approved refunds are paid to the original payment method; if you choose the rebuild, we open the new package in your workspace.

6. When the promise does not apply

The promise does not apply, and no refund or rebuild is owed, if any of the following is true:

  • The following do NOT void the promise: edits made by your recommenders to their own letters, factual corrections, completion of marked placeholders, and formatting changes. What voids it: removing exhibits the platform included, replacing the petition letter's legal arguments with your own, or filing a package other than the one prepared in CaseBuilder for this case.
  • You filed a petition package other than the one prepared for that case in CaseBuilder.
  • The information or documents you provided contained a misrepresentation, an omission, or an inaccuracy, or the denial rests on fraud or misrepresentation.
  • The denial rests on a ground outside the merits of the prepared package, for example a missed deadline, failure to respond to an RFE or NOID, a prior immigration violation or inadmissibility, or ineligibility you did not disclose.
  • The case was obtained free of charge or at a price below 50% of the listed price through a test or promotional credit. Standard launch pricing and published discounts do not affect eligibility.

7. Relationship to our Terms

This promise is part of, and subject to, our Terms of Service. CaseBuilder is document preparation software. It is not a law firm and does not provide legal advice, and your use of it does not create an attorney-client relationship. Nothing here changes the fact that USCIS makes all decisions independently. These terms are governed by the laws of the State of New York. We may update this promise; the version in effect on your purchase date governs that case.
